Distance Sales Agreement

1 – Parties

(Hereinafter referred to as the “SELLER”)

1.2 BUYER (CONSUMER)

The individual who registers through the askdoktor.com website or mobile application and purchases a service.
(Hereinafter referred to as the “BUYER”)

2 – Subject

The purpose of this agreement is to define the rights and obligations of the parties in accordance with the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, with respect to the online consultancy services purchased electronically by the BUYER through askdoktor.com.

3 – Subject of the Agreement

Description of the Service:

The services consist of online consultancy provided by professionals such as doctors, psychologists, and dietitians, purchased by the BUYER via the internet. These services are for informational and second-opinion purposes only and do not constitute diagnosis, treatment, or prescription.

Delivery Method:

The services are delivered digitally via video call, written messaging, voice call, or file sharing.

4 – Service Fee and Payment

4.1 The service fee is determined by the SELLER and published on the website.
4.2 The BUYER shall pay the service fee via credit card, debit card, digital wallet, or other available payment methods.
4.3 Access to the service is not granted until the payment is completed.
4.4 Prices include VAT.

5 – Establishment and Enforcement of the Agreement

This agreement is deemed to be concluded and effective upon the BUYER checking the “I have read and accept the terms” box and confirming the order on the website.

6 – Right of Withdrawal

6.1 According to Article 15/1-h of the Law No. 6502, the right of withdrawal does not apply to services that are performed instantly in an electronic environment and intangible goods delivered instantly to the consumer.
6.2 The BUYER acknowledges that the right of withdrawal cannot be exercised once the service has started.

7 – Rights and Obligations of the BUYER

• The BUYER confirms that the information provided during registration is accurate and complete.
  
• The BUYER agrees to use the service solely for personal needs.
  
• The BUYER accepts full responsibility for any misuse, use on behalf of others, or use outside the intended purpose.
  
• The BUYER declares that they are over the age of 18 and possess full legal capacity.
  

8 – Rights and Obligations of the SELLER

• The SELLER is responsible for ensuring that the services provided are technically secure, lawful, and accessible.
  
• In the event of a technical failure or unavailability of a professional, the BUYER will be notified, and a refund will be provided if necessary.
  

9 – Protection of Personal Data

The SELLER processes the BUYER’s personal data in accordance with the provisions of the Law No. 6698 on the Protection of Personal Data (KVKK) and does not share such data with third parties. Necessary administrative and technical measures are in place. For more details, please refer to the Privacy Policy and Personal Data Disclosure Statement.

10 – Force Majeure

Events beyond the control of the parties such as natural disasters, war, fire, strike, cyberattacks, or infrastructure failure are considered force majeure. During such events, obligations are temporarily suspended and no liability is assumed for any resulting damages.

11 – Dispute Resolution

In the event of a dispute, the BUYER may apply to the Consumer Arbitration Committee or Consumer Courts in their jurisdiction. Monetary thresholds are determined annually by the Ministry of Trade.

12 – Miscellaneous

• The BUYER declares that they have read, understood, and accepted all the terms of this agreement.
  
• Since the agreement is approved electronically, no physical signature is required.
  
• This agreement applies to all service sales made via askdoktor.com.
